Peak Wellness Psychiatry, A Professional Nursing Corporation (“Peak Wellness Psychiatry,” “Peak Wellness,” “we,” “us,” or “our”) operates pwpsychiatry.com and related online services, and provides telehealth psychiatric care to patients located in California, Arizona, Washington, and Nevada. This Privacy Policy explains our practices regarding personal information collected through our website and related online interactions. Our services are intended for individuals age 18 and older, and our website is not directed to anyone under 18.
1. HIPAA and health information
When information is Protected Health Information (“PHI”) subject to the Health Insurance Portability and Accountability Act (“HIPAA”), our use and disclosure of that information is governed by HIPAA and by our Notice of Privacy Practices, available at Section 5 of our Terms and Conditions at pwpsychiatry.com/terms-and-conditions/. If this Privacy Policy and the Notice of Privacy Practices differ with respect to PHI, the Notice of Privacy Practices controls.
2. Information we collect
Depending on how you interact with us, we may collect categories of personal information such as: contact and identity information; appointment, account, scheduling, insurance, billing, and payment-related information; information you provide when seeking or receiving services from us, which is governed by our Notice of Privacy Practices when it is PHI; communications you send to us; and basic website and device information, such as IP address, browser or device type, pages visited, and similar technical information.
3. How we use information
We may use personal information, as permitted by law, to provide and administer our services; to communicate with you; to process scheduling, billing, insurance, and payment matters; to operate, maintain, secure, and improve our website and systems; to comply with legal, regulatory, and professional obligations; and for other purposes you authorize or that are permitted or required by law.
4. How we share information
We may disclose personal information, as permitted by law, to categories of recipients such as health care providers, pharmacies, health plans, service providers, business associates, payment processors, government or regulatory authorities, and other persons or entities at your direction or with your authorization. Vendors that create, receive, maintain, or transmit PHI on our behalf are engaged under a Business Associate Agreement. PHI is disclosed only as permitted by HIPAA, our Notice of Privacy Practices, and other applicable law.
If Peak Wellness Psychiatry is involved in a merger, acquisition, reorganization, or sale of assets, information may be transferred as part of that transaction, and PHI will be transferred only as permitted by HIPAA.
We do not sell personal information.
5. Cookies and online tracking
Our website may use cookies and similar standard website technologies. You can control cookies through your browser settings, although disabling certain cookies may affect website functionality.
Our website does not currently respond to browser “Do Not Track” signals. Third parties may collect information about your online activities over time and across different websites when you visit our site.
We do not place tracking technologies on our patient portal, on any page requiring a login, or on any page through which you submit health information, and we do not transmit Protected Health Information to any third party for advertising or marketing purposes.
6. Communications and your choices
We may contact you by email, telephone, text message, or through the patient portal about appointments, prescriptions, billing, and your care. These are service communications rather than marketing. You may ask us to reach you by a particular method or at a particular number or address, and we will accommodate reasonable requests. You may withdraw consent to text messages or automated calls at any time by replying STOP, by telling any staff member, or by emailing us at the address in Section 11. Standard message and data rates may apply.
We send marketing or educational email only where you have opted in. Every marketing email contains an unsubscribe link. Unsubscribing does not affect service communications.
7. Retention
We retain medical records for the period required by the law of the state in which you received care. Billing records are retained as required by law and by our payer contracts. Marketing contact information is retained until you unsubscribe or ask us to delete it.
8. Security
We use administrative, physical, and technical safeguards designed to protect your information, including encryption in transit and at rest, role-based access controls, unique user credentials, multi-factor authentication for staff accounts, and logging of access to patient records. No method of transmission or storage is completely secure. Please do not send PHI to us by unencrypted email; use the patient portal or our secure messaging platform.
9. Access, corrections, and complaints
You may contact us to request access to, or correction of, personal information you have provided through our website, subject to applicable law and record-retention requirements. We will verify your identity before responding. Your rights concerning PHI and medical records are described in our Notice of Privacy Practices.
If you believe your privacy rights have been violated, you may contact our Privacy Officer at (888) 909-8676 or info@peakwellnesspsych.com. You may also complain to the Secretary of the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
10. California residents
This section applies to California residents and does not apply to PHI governed by HIPAA or to medical information governed by the California Confidentiality of Medical Information Act.
The categories of personal information we collect and the categories of recipients with whom we share it are described in Sections 2 and 4. To request access to or correction of that information, contact us using Section 11. We do not sell personal information. If we begin sharing personal information for cross-context behavioral advertising, we will update this policy and provide any opt-out the law requires. California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for direct marketing purposes; we do not disclose personal information to third parties for their direct marketing purposes.
11. Changes to this policy, and how to contact us
We may update this Privacy Policy from time to time. The effective date above identifies the current version. Material changes will be communicated as required by applicable law.
